Asforthelegislativearena,whereconstitutionalismissupposedtogovern,sub-nationallegislationsandregulationstendtorepresenttwoproblems:oneiswhatIcallspecialinterestlegislation,andtheotherislowqualitylegislation.Ononehand,thetermofspecialinterestlegis-lationalreadyspeaksforitself.TheMadisoniannightmareintheFeder-alistNo.10,whichinsiststhatpoliticsinasmallcommunitytendstobedominatedbyspecialinterestgroups,hasitsChineseversioninlocalpolitics.Thegovernment-businesscoalitions,whichhavebeennurturedbyeconomicreformandshort-termgovernmentalaction,arepervasiveinlocalpolitics.Tomakethingsworse,theabsenceofdemocraticcon-trolsmakeslocalpartybossespettydespots,whocanaffordtodoany-thingtheywantwithoutthefearofpoliticalretributiononelectionday.Sincelocalparty-statesarepreoccupiedbyeconomicprojects,whichareeasilyquantifiedbytheirsuperiorboss,wehavewitnessedtimeandagainhowmanyspecialinterestlawsarepassedtoadvancethelocaleconomyorentrenchlocalpoliticsattheexpenseofallotherval-ues.Secondly,low-qualitylegislationsalsoarisesoutofthelegislativemachineoflocalpolitics.Inthisrespect,theMadisonianobservationisalsorelevanttolocalpoliticsinChina.IncontrasttonationalpoliticsinBeijing,localpolitics,especiallyattheverybasiclevels,isdoomedbytheshort-supplyofeducatedpoliticalelites.InBeijing,professionalsintheLegalOfficeoftheStateCouncilortheNPCSC,manyofwhomachievedtheirdoctoraldegreesfromelitelawschoolsinChina,couldatleastguaranteetheformalintegrityofnationalregulationsorlegislation.Ontheotherhand,low-qualitylocallegislationaccountsforagreatper-centageoftheentiresetofthelegislativeconflicts.
Thedoubleproblemsoflocallegislationarenotaminorissueifwetakeintoconsiderationthefactthattheyactuallycoveralargepartofthelivesofordinarypeople.Sub-nationaldemocracy,whichImeantoincludecompetitiveelection,independentcourts,andthefreedomtocriticizeatleastthelocalgovernment,isthekeytokeepthesepettydespotsinlinewiththepeople.
