Asforthelegislativearena，whereconstitutionalismissupposedtogovern，sub-nationallegislationsandregulationstendtorepresenttwoproblems：oneiswhatIcallspecialinterestlegislation，andtheotherislowqualitylegislation.Ononehand，thetermofspecialinterestlegis-lationalreadyspeaksforitself.TheMadisoniannightmareintheFeder-alistNo.10，whichinsiststhatpoliticsinasmallcommunitytendstobedominatedbyspecialinterestgroups，hasitsChineseversioninlocalpolitics.Thegovernment-businesscoalitions，whichhavebeennurturedbyeconomicreformandshort-termgovernmentalaction，arepervasiveinlocalpolitics.Tomakethingsworse，theabsenceofdemocraticcon-trolsmakeslocalpartybossespettydespots，whocanaffordtodoany-thingtheywantwithoutthefearofpoliticalretributiononelectionday.Sincelocalparty-statesarepreoccupiedbyeconomicprojects，whichareeasilyquantifiedbytheirsuperiorboss，wehavewitnessedtimeandagainhowmanyspecialinterestlawsarepassedtoadvancethelocaleconomyorentrenchlocalpoliticsattheexpenseofallotherval-ues.Secondly，low-qualitylegislationsalsoarisesoutofthelegislativemachineoflocalpolitics.Inthisrespect，theMadisonianobservationisalsorelevanttolocalpoliticsinChina.IncontrasttonationalpoliticsinBeijing，localpolitics，especiallyattheverybasiclevels，isdoomedbytheshort-supplyofeducatedpoliticalelites.InBeijing，professionalsintheLegalOfficeoftheStateCouncilortheNPCSC，manyofwhomachievedtheirdoctoraldegreesfromelitelawschoolsinChina，couldatleastguaranteetheformalintegrityofnationalregulationsorlegislation.Ontheotherhand，low-qualitylocallegislationaccountsforagreatper-centageoftheentiresetofthelegislativeconflicts.
Thedoubleproblemsoflocallegislationarenotaminorissueifwetakeintoconsiderationthefactthattheyactuallycoveralargepartofthelivesofordinarypeople.Sub-nationaldemocracy，whichImeantoincludecompetitiveelection，independentcourts，andthefreedomtocriticizeatleastthelocalgovernment，isthekeytokeepthesepettydespotsinlinewiththepeople.
