本指南是《专利审查指南2023》的英文版。《专利审查指南2023》是专利局依法行政的依据和标准，也是有关当事人在专利申请和请求各个阶段应当遵守的规章。本指南根据2020年修正的《专利法》、2023年修订的《专利法实施细则》、国家知识产权局公告（第391号）等，在《专利审查指南2010（2019年修订）》的基础上进行了修正。本指南共六部分，包括第一部分“初步审查”、第二部分“实质审查”、第三部分“进入国家阶段的国际申请的审查”、第四部分“复审与无效请求的审查”、第五部分“专利申请及事务处理”，以及新增加的第六部分“外观设计国际申请”。

Foreword
The China National
Intellectual Property Administration， as the patent administration department under the State Council， commissions the Patent Office of the China National Intellectual Property Administration (hereinafter referred to as the “Patent Office”) to accept，examine and grant patent for patent applications， as well as review requests for reexamination and invalidation. The Patent Office makes decisions on behalf of and in the name of the China National Intellectual Property Administration.
In order to ensure
objective， impartial， appropriate， and timely handling of patentrelated applimescations
and requests in compliance with the laws， as pursuant to Rule 148 of the “Implementing
Regulations of the Patent Law of the People’s Republic of China”， the China National Intellectual Property Administration enacts these Guidelines for Patent Examination (hereinafter referred to as the “Guidelines”). These Guidelines detail and supplement the provisions of the Patent Law and its Implementing Regulations， and thus serve as bases and standards for the Patent Office to refer to and follow in enforcing the relevant laws and regulations.They are also regulations which the related parties shall abide by at each of the aforesaid stages.
These Guidelines
are made by revision of the previous version of 2010 in light of practice， in accordance with the “Patent Law of the People’s Republic of China”， which has been amended for the fourth time by the “Decision of the Standing Committee of the National People’s Congress on Amending the Patent Law of the People’s Republic of China” (Adopted at the 22th Meeting of the Standing Committee of the Thirteenth National People’s Congress on October 17， 2020)， and the “Implementing Regulations of the Patent Law of the People’s Republic of China”， which has
been amended for the third time by the “Decision of December 11， 2023， of the State Council on Amending the Implementing Regulations of the Patent Law of the People’s Republic of China”， and are hereby promulgated as regulations of the China National Intellectual Property Administration.
